A lease creates a contract
An oil and gas lease gives the lessee rights described in the written agreement. It does not, by itself, prove that the person signing it owns every mineral interest under the tract.
Find the core terms
The document commonly addresses the bonus, royalty, primary term, extension or renewal language, pooling or unit provisions, legal description, and the interest covered. Keep the full lease and every exhibit.
Check the tract and the share
A lease can cover all or part of a mineral interest, including an undivided share held with other owners. Compare the legal description and ownership language with the deed or probate records.
Keep related filings
A memorandum of lease, release, assignment, ratification, or other recorded filing may explain what happened after the lease was signed. No single lease record answers every title question.
